Manana Kobakhidze Deputy Chair of Parliament declared when taking a floor at the PACE, the legislative immunity grants only partial immunity from persecution.
She commented the PACE report on Georgia. The document reads that amendments made in April of 2014 were intentional actions against one of opposition parliamentarian, and were oriented to the decreasing of his immunity. "I would like to tell that such information have nothing in common with the real fact. The above mentioned amendments were made only for the purpose of refining the law in accordance with the Constitution."
At the PACE she made a full report on amendments made in Georgian legislation for parliamentary immunity. She noted that in 2014 April from the legislation on Parliamentarian immunity an Article was removed which stipulated an obligation for Parliamentary consent for criminal liability of the MP. Previously lifting criminal liability immunity for MP was not allowed without consent of the Parliament. The same amendments were made also in the Georgian Criminal process legislation.
Because the legislative collision arise in this respect in the Georgian legislation. She presented a retrospective of legislative changes made in previous years and showed a real motivations of the Georgian government for the amendments made in 2014 for parliamentarian immunity lifting in criminal cases.
