Eka Beselia, leader of political movement "Solidarity for Prisoners of Conscience" said the Strasbourg Court delivering the verdict on the case of Sandro Girgvliani proved that the judicial system of Saakashvili is not free, independent and unbiased. It serves to the strengthening of the regime but not to the defense of legitimate rights of Georgian citizens.
"This verdict was a restoration of the justice. This case became a touching stone between government and a society. It showed in full the cruel, outrageous and criminal regime of Saakashvili. The Strasbourg Court showed clearly that the repressive machinery of Saakashvili - Police, Procurator's Office and Court were acting jointly, organized to hide the truth in the murder case, to hide the Justice. Regardless of passing several years the Justice restored and once more the Strasbourg Court proved that nobody can escape the Justice, and all are equal before the Law. The graveness and large scale of the murder case was preconditioned by the fact that in this killing participated governmental high ranks. Namely those persons who were obliged to keep the public order and justice in the country, were violating it rudely. Instead we have seen how they, government representatives, turned into dangerous criminals. They were trying to escape the liability. The un punishable crime and this syndrome gained a largest degree, "- Beselia said.
She noted that this verdict of the ECtHR is a defeat of Georgian government, because of its repressive policy, investigative system filled with politics and corrupted Justice. The government will be obliged to admit these mistakes and to return for reinvestigation of this case under the verdict.
The decision of Strasbourg Court of Human Rights was delivered today. Court found violation of Article 2 of the European Convention on Human Rights - right to life. The investigation carried out in the internal bodies - in the Ministry of Internal Affairs, in Procurator's Office and in the Court, were not consistent with the norms of the Convention. The Court found violation of the Article 38 of the regulations according to which the government is obliged to provide assistance and cooperation to the Court (ECtHR) in fact finding. The Georgian government falsified the proofs presented to the Court. The right to life and fair Justice were violated, and no separate discussion was held by the Court in this respect.
The Court obliged the Georgian government to pay off 50 thousand EUR to Guram Girgvliani, plaintiff in three months period.
