Zaza Gabunia, Christian-Democrat's member in Sakrebulo (Tbilisi City Assembly), Chair of the Human Rights Committee defense hold a press conference. He discussed the decision which was taken in breach of legislation.
MP said the imposition of a monthly fee for waste collection services tied to the electricity bills is a violation committed by the Sakrebulo majority. Particularly this is a violation of a legislation about "Local tax collection" Article 12, which restricts maximal amount for the waste collection above GEL 3 per month.
Zaza Gabuni said Sakrebulo exceeded its powers and got into controversy with the Parliamentary decision as, according to the law on "local self governance" Article 15 it is not admissible to use a power in such a way that may lead to the violation of Georgian legislative acts. This invoked a conflict with the constitutional decision on 2007 according to which "the imposition of a special norms which are restricting the free choice of a customers, or imposed disadvantageous conditions for customers, may be justified only in case if no other ways are possible for use of these goods." Zaza Gabunia said there was no such strong ground to take this decision.
Taking all this inconsideration next week Christian-Democrats will pass a legal pleading to the Constitutional Court for abolition of above-mentioned decision.
