Christian-Democrats demand amendments to the GCC (Georgian Criminal Code) Articles 55 and 59 concerning the principles of absorption of punishment.
The Christian-Democrats' members of the Human Rights Committee said this today. Tamaz Bakuridze, Committee Chair said it is not admissible that Judges cannot take a decision independently in terms for easing of sentence, all its actions depend on the Procurator' Office.
"The procedural agreement must not become the only precondition for Judge delivering the easier sentence. After the full and partial absorption principles for the sentence were abolished, the terms of imprisonment became tree-times longer. There are cases when the punishment for not too grave violations are reaching 30 years," - Bakuridze said.
CDM, Human Rights Committee informed that for the last period of time the courts are delivering sentences with a stricter policy of summing up sentences, this considerably increased number of unjust sentences. Such approach damages sentenced persons and the Court investigation.
Christian-Democrats intentionally confided this demand for liberalization of a GCC with the international day against torture and inhuman and degrading treatment.
