Giotgi Tughushi, Public Defender said in Georgia the investigation in most cases has only a formal nature. Tughushi said this today at the conference "The World without torture" in the Court Yard Marriot.
"The investigation has a formal nature mainly. Very often it may be accomplished with the closing of a case or the prolongation of the investigation. The facts of torture, what is very sad, are closing based on the evidences of Policemen itself. As a rule the victims are refusing its evidences given to the defender and are giving new evidence in favor of law enforcers. In such cases the forensics is not provided or is carried out in such time when all traces of torture disappear," - Tughushi said.
He underlined that the Procurator's Office General in most cases is very inattentive to the cases of detained persons and not investigates appropriately the cases concerning violations of such persons' rights. The facts of torture are frequently turning into the facts of "exceeding of powers" or beating.
Tughushi said the ineffective investigation into the facts of torture hinders to the elimination of its occurrence.
