The GYLA (Georgian Young Lawyers Association) declares that the 2011 June 27 agreement with opposition contradicts to the will of public expressed over referendum of 2003. Accordingly the Parliament will enforce this agreement unlawfully and unconstitutionally.
For information, on June 27 of 2011 the opposition parties and the Parliamentary majority concluded an agreement which stipulates the increase of number of Parliamentarians from 15 to 190.
At the same time on September 2 of 2003 according to the Order No 428 of the President a referendum was held on the question: "Do you agree to decrease number of Parliamentarians and make it no more than 150 MPs?"
The above mentioned referendum was held on November 2 of 2003. 1 904 105 people take part in it. To the question agreed an absolute majority of a people - 1 590 00.
On February 23 of 2005 the amendments were made in the Georgian Constitution Article 49, which stipulates number of Parliamentarians elected over proportional elections as 100 people and over majority system - 50 people.
GYLA calls the government and the opposition to respect the November 2 referendum results and a will of the nation. Incase if the referendum results should be changed, it could be done in accordance with the law established. Namely this should happen according to the law on "Referendums results" Article 28. Where it is indicated that the results of a referendum can be changed only over the referendum.
